Why should I settle my divorce case? Do most cases settle and not go to trial?
Welcome to the Settlement edition of “Doing Divorce Differently.”
My name is Steven Leskin. I am a divorce attorney in Portland Oregon. I have been practicing in Oregon since 1992.
Most divorce cases settle. In the vast majority of cases, the parties come to an agreement before trial. Sometimes, parties acting in good faith just cannot reach an agreement and the divorce goes before a judge.
Most times though, parties are able to come to an agreement. It is generally agreed that settlement is better than allowing a judge to decide the issues which will control people’s post married life for years to come.
It is just a fact that, no matter how confident you are in your case, there is always a risk that you will not get what you expect or believe that you are entitled to receive under the law. Additionally, there is some significant cost benefit analysis to settlement. It will not cost as much as a day in court and it is less stressful than going to trial.
