What is an attorney trust fund?

Many divorce attorneys ask for a retainer of $3,000 or more “to get started on your case.” The firm may tell you that you are required to keep a certain minimum balance in your trust account. The firm bills you for its time, and then deducts the invoice amount from the money in trust. In some months, it is easy for the invoice to exceed $3,000 and you may be required to replenish the trust fund account in full. While it may cost $3,000 to get started, the attorney fees will easily exceed that amount. Try asking how much the whole divorce will cost from a prospective divorce lawyer. See if you get a definitive answer.
